By accessing or using MillerSoft's background screening services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Services.

2. Description of Services

MillerSoft provides background screening and verification services including, but not limited to:

• Identity verification
• Employment history verification
• Education verification
• Criminal record checks
• Professional license verification
• Reference checks

3. FCRA Compliance

As a Consumer Reporting Agency (CRA) under the Fair Credit Reporting Act (FCRA), we require all clients to:

• Certify a permissible purpose for each background check request
• Obtain proper written consent from candidates before initiating a check
• Provide candidates with required disclosures
• Follow adverse action procedures when taking unfavorable employment actions

4. Client Obligations

By using our Services, you agree to:

• Use background check information only for lawful purposes
• Not use information for discrimination based on protected classes
• Maintain confidentiality of all screening reports
• Comply with all applicable local, state, and federal laws
• Provide accurate information when submitting screening requests
• Follow proper adverse action procedures as required by FCRA

5. Account Registration

To use our Services, you must:

• Create an account with accurate and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Accept responsibility for all activities under your account

6. Payment Terms

• Prices are displayed in Euros (€) unless otherwise specified
• Payment is due upon submission of screening requests
• We accept major credit cards and bank transfers
• Invoices are issued for completed screenings
• Refunds are not provided for completed screenings

7. Service Level

We strive to complete screenings within the estimated timeframes provided. However, turnaround times may vary based on:

• Verification source response times
• Completeness of candidate information
• International verification requirements
• Court or institution availability

8. Accuracy and Disputes

We take reasonable steps to ensure the accuracy of our reports. If a candidate disputes the accuracy of information in a report:

• We will conduct a reinvestigation within 30 days
• If information is found to be inaccurate, we will correct it
• Updated reports will be provided to you and the candidate

9. Limitation of Liability

To the maximum extent permitted by law:

• Our liability is limited to the fees paid for the specific screening in question
• We are not liable for indirect, incidental, or consequential damages
• We are not liable for decisions made based on screening information
• We are not responsible for delays caused by third-party verification sources

10. Indemnification

You agree to indemnify and hold harmless MillerSoft from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your misuse of screening information
• Your failure to comply with applicable laws
• Any claims brought by candidates related to your use of our Services

11. Termination

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Suspected fraudulent or illegal activity
• Non-payment of fees
• At our sole discretion with reasonable notice

12. Governing Law

These Terms are governed by the laws of Romania and the European Union. Any disputes shall be resolved in the courts of Romania.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through our platform. Continued use of the Services after changes constitutes acceptance of the modified Terms.
